The court found that the grant issued in Nyeri H.C. Succession Cause No. 179 of 2008 was irregular because a valid and confirmed grant had already been issued to Patrick Mwangi Gichu in Othaya R.M.C. Succession Cause No. 30 of 2008. The existence of two grants for the same estate is impermissible under the Law of Succession Act. Therefore, the court revoked the later grant and struck out the cause, holding that consolidation was not possible or appropriate in these circumstances. The parties were directed to proceed with the hearing of Nyeri H.C. Succ. Cause No. 863 of 2010, as the earlier confirmed grant took precedence.
