Ratio Decidendi

The court found that the previous High Court cases (HCCC 26/1988, 27/1988, 28/1988) had been dismissed for want of prosecution or non-attendance and had not proceeded to hearing. As such, there were no valid proceedings or evidence that could be adopted in the present consolidated suit (ELC 555/2016 & 94/2018). The court held that the application to adopt any proceedings from the closed files was misconceived and could not be granted. The consolidated suit must proceed de novo, and the older High Court files are to be retained for reference only, not for evidentiary adoption. The parties were directed to appear for further directions regarding the hearing of the consolidated case.
