The court found that the plaintiff's refusal to surrender the original title deed, as required to effect the judgment, would frustrate the enforcement of the court's orders. Since the title had already been cancelled by the judgment and the defendant was entitled to registration of 2.5 acres, the court held that it was necessary to dispense with the production of the original title deed to prevent the judgment from being rendered hollow. The court therefore ordered the plaintiff to surrender the title within 30 days, failing which the Land Registrar was authorized to cancel the title administratively and issue the defendant with a new title for 2.5 acres, notwithstanding the absence of...
