The court held that although the respondent raised the issue of jurisdiction, he did not provide sufficient evidence to prove the matter fell within the exclusive jurisdiction of the Employment and Labour Relations Court. In the absence of such proof, the High Court would not decline jurisdiction at this stage but would revisit the issue if further evidence emerged.
