The court found that the grant of letters of administration intestate issued to the petitioner was obtained irregularly and contrary to law, as the applicant, a beneficiary of equal priority, was not notified nor did she give consent as required by Section 66 of the Law of Succession Act and Rule 26(2) of the Probate and Administration Rules. The petitioner substituted consents from his wife and son, who were of lesser priority, instead of his sisters. The court also determined that the portion of Plot No. 3B Makutano owned by the deceased forms part of the estate until the cause is determined, as there was insufficient evidence of joint ownership and survivorship.
