Employment Cause / Judgment

  1. 1 Whether the Claimant’s dismissal was lawful and fair.
  2. 2 Whether the Claimant is entitled to the remedies sought.
  3. 3 Whether the Respondent has made out a proper counterclaim against the Claimant.

Ratio Decidendi

The court found that the Claimant's resignation was never accepted by the Respondent, and thus the employment relationship persisted at the time of dismissal. The Respondent failed to notify the Claimant of the specific charges against him and did not provide a valid reason for dismissal as required by law. The purported opportunity for a post-dismissal hearing was illusory and did not satisfy the procedural fairness requirements under Section 41 of the Employment Act, 2007. Consequently, the dismissal was both substantively and procedurally unfair. The Respondent's counterclaim was dismissed for lack of evidentiary support.

Court Disposition

Judgment for the Claimant; Respondent's counterclaim dismissed.
