The court found that although the appellant had previously filed an appeal which was dismissed on technical grounds, the appeal was never heard on its merits. In the interest of justice and pursuant to Article 159 of the Constitution, the court held that the appeal was properly before it. Upon reviewing the evidence, the court determined that the trial court was unable to assign greater blame to any party and that the only reasonable course was to follow the precedent set in Muranga CMCC No.515 of 2003 by apportioning liability at 50%:50% between the appellant and the 2nd and 3rd defendants.
