Ratio Decidendi

The court held that the affidavit in support of the election petition was not commissioned as required by law because it was purportedly commissioned by a firm of advocates rather than an individual advocate duly appointed as a commissioner for oaths. This defect was substantive, not procedural, and could not be cured by Article 159 of the Constitution. As a result, the affidavit was incurably defective and had to be struck out. Without a valid supporting affidavit, the petition itself was rendered incompetent under the mandatory requirements of Rule 8(4)(b) of the Election Petition Rules. The election court did not err in law in striking out both the affidavit and the petition....
