The High Court found that the trial court erred in law and fact by convicting the appellant on evidence that did not meet the required standard of proof in criminal cases. The item allegedly recovered from the appellant's house was not shown to have been stolen from the complainant, nor was it listed in the charge sheet. The doctrine of recent possession was misapplied as there was no nexus between the recovered item and the offence. Furthermore, the trial court failed to adequately consider the appellant's defence and did not address contradictions in the prosecution's evidence. As a result, the conviction was unsafe and could not be sustained.
