Ratio Decidendi

The Court determined that the error in the description of legal representation was a minor typographical mistake that did not affect the substance of the ruling. The correction was necessary to accurately reflect the intention of the Court and the actual representation of the parties. The Court exercised its power under Rule 35(1) of the Court of Appeal Rules, 2010, to correct the record so that Ms. Koki Mbulu is properly identified as counsel for the applicant and Mr. Mwicigi as counsel for the 1st respondent. The correction did not prejudice the opposite party and was purely administrative in nature.

Court Disposition

Application for correction of typographical error allowed.

Orders

  • The sentence at page 2 of the ruling, lines 4–6 from the top, is corrected to read: 'Learned counsel Miss Koki appeared for the applicant while learned counsel, Mr. Mwicigi appeared for the 1st respondent.'
  • There will be no order as to costs.
