Miscellaneous Application / Judgment

  1. 1 Whether the respondent is under a statutory duty to issue the applicant with a lease for Plot No. D6/1 Huruma.
  2. 2 Whether an order of mandamus can issue to compel the respondent to issue a lease to the applicant.
  3. 3 Whether the applicant has a legal right to the relief sought.

Ratio Decidendi

The court found that the applicant failed to establish a legal right to be issued with a lease by the respondent, as the power to alienate public land now vests in the National Land Commission under the Constitution of Kenya. The respondent, Nairobi County Government, no longer has jurisdiction to issue leases for public land held in trust for county residents, as such actions must comply with statutory provisions and the constitutional framework. An order of mandamus cannot compel a public body to perform an act outside its legal authority or jurisdiction. Therefore, the application for mandamus was dismissed for lack of merit.
