The Plaintiff failed to annex a certified extract of the title to the suit land to the originating summons, as required by Order 37 Rule 7 of the Civil Procedure Rules. This omission is fatal to the claim for adverse possession, as the law mandates that adversity of title must be established against a known owner, and the Plaintiff must prove the Defendant is the registered proprietor. Without the title document, the Court cannot determine the Defendant's ownership or grant the orders sought. The Court therefore found the suit incompetent and struck it out.
