Ratio Decidendi

The court found that the applicant and his witnesses were present at the court premises and ready to proceed, but the failure to enter the courtroom was due to the conduct of the applicant's counsel and the counsel holding brief. The court held that it would be unjust to punish the applicant for the mistake of his counsel. Exercising its discretion under Order 12 Rule 7 of the Civil Procedure Rules and guided by the principle in Ivita v Kyumbu, the court allowed the application for reinstatement of the suit, subject to the applicant paying thrown away costs to the respondents, assessed at Kshs. 20,000.
