Ratio Decidendi

The court held that the power to transfer suits under Section 18 of the Civil Procedure Act is only exercisable where the suit was initially filed in a court with jurisdiction. Since the Ruiru SPMC ELC Case No E067 of 2021 was filed in a magistrate court that lacked pecuniary jurisdiction over the subject matter, the suit was a nullity ab initio. As such, there was nothing competent to transfer to the Environment and Land Court at Thika. The application for transfer was therefore not merited and was dismissed, even though it was unopposed.
