The respondents failed to provide any material to rebut the veracity of this official record. No certificate of delay was issued, and no application for extension of time to file the record of appeal was made. Consequently, more than sixty days elapsed without the record of appeal being filed. Applying Rules 82 and 83 of the Court of Appeal Rules, the court held that the Notice of Appeal dated 25th June 2013 must be deemed as withdrawn. The respondents are liable for the costs of the application.
