Ratio Decidendi

The court held that the application for bail pending appeal was incompetent because the applicants had not filed an appeal in the High Court against the judgment and sentence of the lower court. Section 357(1) of the Criminal Procedure Code expressly requires that an appeal must first be entered before an application for bail pending appeal can be entertained. The court further clarified that the concept of an 'intended appeal' is not recognized under the Criminal Procedure Code, and thus cannot form the basis for such an application. Consequently, the application was struck out as incompetent.
