Ratio Decidendi

The court found that the respondent's objections to the lifting of the prohibition order were based on issues already determined during the confirmation proceedings. The respondent had not appealed the judgment confirming the grant, and although he filed an application for review, he had taken no steps to prosecute it for over a year. The court held that, in the absence of any order setting aside the confirmation of grant, and given the unexplained delay in pursuing any challenge, there was no justification to maintain the prohibition order. The applicant's summons was therefore merited, and the prohibition order was vacated to allow the estate to be devolved as per the confirmed grant.
