The court held that the suit was competent and properly before it, as previously determined in a related consolidated case. In assessing damages, the court considered the nature and extent of the injuries, most of which were blunt injuries, and determined that Kshs.200,000 was adequate compensation for pain, suffering, and loss of amenities. An additional Kshs.5,000 was awarded as special damages for the attendance of the medical witness. The total award was Kshs.205,000, with costs and interest to the plaintiff.
