Procedural Posture

Civil Suit / Ruling on Application to Strike Out Defence and for Summary Judgment

  1. 1 Whether the defendants' statement of defence should be struck out as scandalous, frivolous, vexatious, or an abuse of court process.
  2. 2 Whether the plaintiffs are entitled to summary judgment for Kshs. 81,880,000/-.
  3. 3 Whether the defence raises triable issues that require determination at a full trial.

Ratio Decidendi

The court found that the defence filed by the defendants raises triable issues that require evidence and determination at a full trial. The court emphasized that striking out pleadings is a drastic measure only to be used where a pleading is plainly unsustainable and incapable of amendment. In this case, the defence was not so hopeless as to warrant being struck out, and the plaintiffs would not suffer prejudice other than a delay in the determination of their claim. The court concluded that it would be unjust to deny the defendants an opportunity to present their case and that the matter should proceed to full trial for all issues to be ventilated and determined on their merits.

Court Disposition

Application dismissed with costs to the defendants.
