Under Section 90 of the Employment Act, 2007, the Claimant was required to file his claim within three years, by 8th August 2011. The claim was instead filed on 6th August 2012, outside the statutory limitation period, and no leave of court was sought to extend time. The court held that limitation of action is a substantive legal issue that must be determined once raised.
