The magistrate improperly relied on evidence from a witness (PW 2) who was not recalled for cross-examination and selectively accepted parts of another witness's (PW 4) testimony without declaring him hostile. These procedural and evidentiary errors undermined the fairness of the trial and the reliability of the conviction. The court concluded that the appellant was not properly convicted and that the conviction could not stand.
