The Plaintiff admitted to defaulting on the loan facility and failed to provide a valid legal or factual basis to excuse the default. The illness cited by the Plaintiff predated the loan agreement and was not a factor at the time of contracting. The Plaintiff did not dispute the Defendant's evidence that the LPO proceeds were not paid through the Plaintiff's account as agreed, nor did he deny having received payment for the LPOs. The Plaintiff did not challenge the legality or existence of the charge over the property in his pleadings or affidavit, and thus the Defendant was under no obligation to prove it. There was no specific prayer for taking of accounts, and the Plaintiff's issues...
