The High Court found that execution proceedings are indeed 'proceedings' for the purposes of section 18 of the Civil Procedure Act and thus amenable to transfer. The court held that while the applicant's allegations of bias or unfairness against the trial magistrate may be susceptible to explanation and may not necessarily indicate actual bias, the cumulative effect of the manner in which the proceedings were conducted—particularly the repeated issuance of warrants of arrest and committal orders contrary to subsisting High Court directives—was sufficient to create in the mind of the applicant a reasonable apprehension of unfairness.
