The Applicant failed to controvert the Respondent's evidence that she vacated the premises and that the property was subsequently leased to a third party. Citing Re Hebtulla Properties Ltd (1979) eKLR, the Tribunal held it has no jurisdiction to order reinstatement of a tenant after execution of an order for possession and transfer to a third party.
