The court found that while the appellant raised an arguable point on appeal regarding the lawfulness of the fines imposed, he failed to demonstrate that he would suffer substantial loss if the order for stay was denied. The appellant did not allege or prove that the sums ordered to be paid would not be refunded if the appeal succeeded. Furthermore, the appellant did not offer security for the due performance of the decree. As the requirements for granting a stay of execution were not satisfied, the court exercised its discretion to dismiss the application for stay. The motion was therefore found to lack merit and was dismissed with costs to the respondent and the Interested Party.
