Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the court can grant a stay of execution of a judgment that merely dismissed an appeal and did not issue any positive orders capable of execution.
  2. 2 Whether the applicant has demonstrated sufficient grounds for the grant of stay of execution pending appeal.

Ratio Decidendi

The court found that the judgment delivered on 23rd February 2018 merely dismissed the appellant's appeal and did not issue any positive orders or decree capable of execution. Order 42 Rule 6 of the Civil Procedure Rules provides for stay of execution of a decree or order, not a judgment. Since there was no decree or order arising from the judgment that could be executed, the application for stay was not merited. The court therefore dismissed the application in its entirety with costs to the respondent, without considering the substantive principles for stay of execution, as the threshold requirement of an executable order or decree was not met.

Court Disposition
