Ratio Decidendi

The Tribunal found that the Landlord failed to prove the grounds of rent arrears and failure to remit rent promptly, as no evidence was adduced to support these claims. However, the Landlord established that he genuinely intended to take possession of the premises for his own use, specifically to convert the premises into a restaurant, which is a valid ground for termination under Section 7(g) of Cap. 301. The Tenant did not challenge this intention or provide evidence of ill motive. The Tribunal held that the Landlord's notice to terminate tenancy succeeded on this ground alone, and the Tenant was ordered to vacate the premises within thirty days.
