Ratio Decidendi

The court found that the grant of letters of administration was obtained by the respondent through concealment of material facts, including the existence of two widows and eleven children of the deceased, as well as additional assets. The respondent, being a daughter-in-law, was not entitled to priority over the widows in the administration of the estate according to section 66 of the Succession Act. The failure to disclose these facts rendered the proceedings defective in substance and justified revocation of the grant under section 76 of the Succession Act. The court therefore revoked the grant and directed that the two widows were at liberty to apply for fresh grants.
