The court found that while the claimant was a registered N.S.S.F. member with consistent contributions, the total benefit from N.S.S.F. after 10 ½ years was significantly less than the service pay calculated at 15 days’ salary per completed year of service. Section 35(6) of the Employment Act 2007 intends to prevent double social security payments, but does not bar an employee from receiving the superior benefit available. The court adopted the prevailing judicial approach of awarding service pay at 15 days’ salary per year in the absence of a contractual provision, less the amount already accrued in the N.S.S.F. account. The claimant was therefore entitled to Kshs. 380,769 (service pay)...
