Procedural Posture

Miscellaneous Application / Ruling on Application for Extension of Time and Stay of Execution Pending Appeal

  1. 1 Whether the applicants have demonstrated sufficient cause for extension of time to file an appeal out of time.
  2. 2 Whether the applicants are entitled to an order for stay of execution pending the hearing and determination of the intended appeal.
  3. 3 What conditions, if any, should be imposed for the grant of stay of execution.

Ratio Decidendi

The court found that the applicants brought the application for extension of time within two months of the judgment, which was not an unreasonable delay. The explanation for the delay, being the time taken to obtain instructions after the advocate's opinion and the applicants' absence at the judgment delivery, was deemed reasonable. Application allowed in respect to extension of time and stay of execution, subject to conditions.
