The court found that the issues raised in the present suit had already been determined by the Land Disputes Tribunal and adopted as a judgment of the court in previous proceedings involving the same parties or those under whom they claim. No appeal was filed against that determination, and the orders were executed. The plaintiff's claim for a declaration of ownership and injunction was therefore barred by the doctrine of res judicata. Furthermore, the court held that any boundary dispute between the parties must first be determined by the Land Registrar as mandated by Section 21 of the Registered Land Act, and the court lacked jurisdiction to entertain the matter until that process was...
