The court found that the application for stay of execution was filed without unreasonable delay and that the applicants conceded owing the respondent a substantial sum. However, the applicants failed to demonstrate, with evidence, that the respondent would be unable to refund the decretal sum if the appeal succeeded. The court held that the right to stay must be balanced with the respondent's right to enjoy the fruits of judgment. Given the applicants' concession of part of the debt and the joint ownership of the subject motor vehicle, the court exercised its discretion to grant stay of execution, but only on condition that the applicants deposit Kshs. 1.5 million as security in a joint...
