Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant's employment was unfair and unlawful.
  2. 2 Whether the Respondent complied with statutory requirements for procedural and substantive fairness in termination.
  3. 3 Whether the Claimant is entitled to compensation and terminal dues.

Ratio Decidendi

The Court found that the Respondent failed to comply with statutory requirements for both procedural and substantive fairness in terminating the Claimant's employment. The Claimant was not given notice or an opportunity to be heard, and the Respondent did not provide or prove any valid reason for the dismissal. The Respondent's failure to file a response or adduce evidence meant the Claimant's case was unchallenged. The Court held that the dismissal was unfair and unlawful, and awarded the Claimant compensation equivalent to six months' wages, one month's pay in lieu of notice, and one month's leave pay. The claim for unpaid salary was dismissed for lack of evidential basis.

Court Disposition

Claim partly allowed; termination declared unfair; compensation and terminal dues awarded.
