The High Court determined that it lacked jurisdiction to hear and determine the appeal as the subject matter related to land, which falls within the exclusive jurisdiction of the Environment and Land Court as established under Article 162(2)(b) of the Constitution and the Environment and Land Court Act. The court found that any determination on the merits would be ultra vires the Constitution. Although the application before the court was for dismissal of the appeal for want of prosecution, the court held that it would be inappropriate to make any orders on the substance of the appeal and instead directed the transfer of the appeal and lower court record to the Environment and Land Court...
