While the applicant opposed the provision of security, the court held that a balancing act was necessary. The 1st respondent, being a financial institution, would be able to refund the amount if the appeal succeeded. However, to protect both parties' interests, the court exercised its discretion to grant a stay of execution on condition that the applicant deposits half the decretal sum (Kshs. 331,309.45) in an interest-earning account jointly held by the parties' advocates within 14 days....
