Ratio Decidendi

The court found that the Defendant failed to prove that the Plaintiff was guilty of gross misconduct or serious neglect of duty, as the evidence relied upon (the Plaintiff's alleged statement) was not produced and no other substantive evidence was adduced. Consequently, the Defendant was not entitled to summarily dismiss the Plaintiff. The employment contract required either party to give one month's notice or pay one month's salary in lieu of notice for termination. The Defendant neither gave notice nor paid salary in lieu of notice, rendering the termination wrongful. The Plaintiff was entitled to unpaid salary for the period of suspension and one month's salary in lieu of notice....
