The Tribunal found that the tenant failed to provide clear and legible evidence of rent payment, while the landlord's statement of account showing rent arrears was unchallenged. The landlord's notice to vacate was found defective for failing to comply with section 4(2) of Cap 301, rendering it of no effect. However, the existence of rent arrears entitled the landlord to exercise the statutory right of distress for rent under Cap 293. The Tribunal restrained the landlord from illegally terminating the tenancy but allowed the landlord to pursue distress for rent legally due. Costs of the application were left to abide the outcome of the reference.
