Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the trial magistrate erred in finding the appellant 100% liable for the accident.
  2. 2 Whether the award of Kshs.350,000 as general damages was manifestly excessive in the circumstances.

Ratio Decidendi

The High Court found that the trial magistrate's finding on liability was based on the uncontroverted and unchallenged evidence of the respondent's witness, and the appellant failed to call the driver to rebut this evidence. The grounds of appeal on liability were therefore without merit. On the issue of quantum, the court held that the award of Kshs.350,000 was reasonable, as it was based on comparable injuries and awards, and took into account relevant factors such as the year of comparable awards and inflation. The authorities cited by the appellant were outdated and not comparable. The appeal was found to lack merit and was dismissed in its entirety.

Court Disposition

appeal dismissed

Orders

  • The appeal is dismissed in its entirety.
  • The respondent shall have costs of the appeal.
