Procedural Posture

Civil Case / Judgment

  1. 1 Whether the plaintiffs are the registered proprietors of the suit premises and entitled to exclusive possession thereof.
  2. 2 Whether the defendants are trespassers on the suit premises.
  3. 3 Whether the plaintiffs are entitled to a permanent injunction and eviction order against the defendants.

Ratio Decidendi

The court found that the plaintiffs had proved, through unchallenged documentary evidence, that they were the registered proprietors of the suit premises. The defendants' occupation was unauthorized and amounted to trespass. The 1st defendant's defence was not properly on record and, in any event, did not displace the plaintiffs' proprietary rights. The plaintiffs were thus entitled to a permanent injunction and eviction order. However, the claim for mesne profits was denied due to lack of evidence. The court emphasized that ownership of land includes the right to occupation and use, and the defendants had no legal basis to remain on the property.

Court Disposition

Judgment for the plaintiffs; permanent injunction and eviction order granted; mesne profits denied; costs awarded to plaintiffs.

Orders

  • A permanent injunction restraining the defendants, their servants and/or agents from invading and/or trespassing into land parcel No. Wanjare/Bokeire/4410.
  • The defendants and their families to vacate and hand over the suit premises with vacant possession to the plaintiffs within sixty (60) days of service of the decree or order, failing which they will be forcibly evicted.
