Procedural Posture

Notice of Motion / Ruling on Interlocutory Injunction Application

  1. 1 Whether the Plaintiffs have established a prima facie case with a probability of success for the mandatory and prohibitory injunctions sought at this stage.
  2. 2 Who should bear the costs of the application.

Ratio Decidendi

The Plaintiffs failed to establish a prima facie case for the grant of mandatory or prohibitory injunctions. The evidence presented, particularly the claim that the Defendant caused damage based on hearsay from the Chief, was disputed and could only be properly tested at a full hearing. No special circumstances were demonstrated to justify a mandatory injunction at this stage. The Defendant's possession of the land and challenge to the Plaintiffs' title further indicated that the matter required substantive hearing on the merits. Accordingly, the application for injunctions was dismissed with costs to the Defendant.

Court Disposition

application dismissed

Orders
