Ratio Decidendi

The court found that the suit had been dismissed for non-attendance and want of prosecution, and an application for reinstatement was also dismissed as unmeritorious. With no pending suit, the basis for the inhibition and caution on the suit properties no longer existed. Section 73 of the Land Registration Act gives the court the authority to remove a caution in such circumstances. The court therefore allowed the application to lift the inhibition and caution, as their continued existence was unjustified.

Application allowed. Inhibition and caution on LR Nos Njia/burieruri/733 and Njia/burieruri/2502 to be lifted forthwith.
