The grounds of appeal were not frivolous and merited consideration. Although the application for stay was filed close to the expiry of the grace period, the court held that errors of previous advocates should not prejudice the applicant. The court therefore granted a conditional stay of execution of the judgment and decree, pending determination of the appeal, on condition that the applicant deposits Kshs 300,000 as security for costs within 45 days, failing which...
