The court cannot exercise its discretion to admit an appeal out of time unless the appeal exists and can be perused as required by Section 79B. The applicant failed to file the proposed appeal and did not provide a certificate of delay or sufficient explanation for the delay. The absence of these mandatory requirements rendered the application incompetent and an abuse of court process. Consequently, the application for leave to file an appeal out of time was dismissed with costs to the respondent.
