Ratio Decidendi

The court found that the appellant was hit while standing at a designated stage, but failed to demonstrate vigilance or attempt to avoid the accident. The apportionment of liability at 90:10 in favour of the appellant was deemed fair, as both parties bore some responsibility. On damages, the trial magistrate erred in adopting the appellant's age at the time of the medical report rather than at the time of the accident, and the average daily wage should have been Kshs. 600 based on the evidence. The appropriate multiplier, considering retirement age and life expectancy, was 21 years. The court recalculated the award for loss of earning capacity to Kshs. 3,402,000, subject to 10%...

Court Disposition

Appeal allowed in part.

Orders

  • The award of Kshs. 1,090,000 for loss of earning capacity is set aside and replaced with Kshs. 3,402,000, subject to 10% contributory negligence.
  • All other awards by the trial court remain undisturbed.
