Procedural Posture

Miscellaneous Application / Ruling on Application for Extension of Time and Stay of Execution

  1. 1 Whether the applicants have demonstrated sufficient cause to warrant extension of time to file an appeal out of time.
  2. 2 Whether the applicants are entitled to a stay of execution of the judgment and/or decree pending the intended appeal.

Ratio Decidendi

The court found that the applicants failed to provide a sufficient explanation for the delay in filing the appeal. The supporting affidavit was sworn by counsel without disclosing the source of information or grounds for belief, contrary to established legal principles. The court held that no sufficient reason was given for the delay, and therefore the conditions for extension of time were not satisfied. Without an order extending time, the prayer for stay of execution could not be granted. Consequently, the application for extension of time and stay of execution was dismissed with costs.
