Ratio Decidendi

The court found that although the reasons cited by the Respondent for the Claimant's dismissal—such as insubordination, absenteeism, and abusive language—could justify termination, they did not warrant summary dismissal. More importantly, the Respondent failed to comply with Section 41 of the Employment Act, 2007, by not giving the Claimant a hearing before dismissal. The lack of procedural fairness rendered the dismissal unfair and unlawful. Consequently, the court converted the summary dismissal to a normal termination and awarded the Claimant compensation for unfair termination and notice pay.
