The auctioneer's conduct in proceeding to have the consent adopted despite knowledge of the appellants' withdrawal amounted to misrepresentation. The court further held that it was unconscionable and unjust for the auctioneer to demand multiple payments for storage and attachment of the same vehicle in related cases, as only one vehicle was attached and stored once.
