Ratio Decidendi

The High Court found that the trial court properly evaluated the evidence and correctly apportioned liability at 35% to the Appellant, 35% to the third party, and 30% to the deceased, consistent with the findings in a related appeal. The court also held that the quantum of damages awarded for pain and suffering, loss of expectation of life, loss of dependency, and special damages was reasonable and supported by the evidence and legal principles. There was no basis for appellate interference with the trial court's findings on either liability or quantum. The appeal was therefore dismissed in its entirety, with costs to the Respondents.
