The tribunal found that the notice of termination dated 20th November 2023 was not in the prescribed form, did not provide the required two months' notice, and failed to specify any grounds for termination as mandated by the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. The purported notice was therefore a nullity ab initio and of no legal effect. The landlord did not establish, on a balance of probabilities, that the tenant was in rent arrears, as this was not raised in the notice or supporting affidavits and was unsupported by evidence.
