Procedural Posture

Civil Application / Application for Leave to File Appeal Out of Time

  1. 1 Whether the applicant should be granted leave to file a notice of appeal out of time against the High Court judgment.
  2. 2 Whether the applicant was properly served with notice of the judgment date.
  3. 3 What principles govern the court's discretion to extend time for filing an appeal.

Ratio Decidendi

The court found that while the respondents claimed notice of judgment was served and the matter was on the cause list, there was no proof that the applicant actually received the judgment notice. The court held that it is insufficient to rely solely on the cause list as evidence of notice to a litigant. In the absence of proof of service of the judgment notice to the applicant, the court exercised its discretion to allow the application for extension of time. The applicant was thus granted leave to file its notice of appeal out of time, with the notice to be filed and served within seven days.
